Subject: 19207/Payment-Chatt Metro Airport Authority/E.Metro Express Site Date: Mon, 14 Oct 1991 10:20:00 -0500 RESOLUTION NO. 19207 A RESOLUTION AUTHORIZING PAYMENT OF ONE-FOURTH (1/4) OF THE EXPENSE FOR ADDITIONAL ENVIRONMENTAL TESTING AT THE EASTERN METRO SITE AND AUTHORIZING THE MAYOR TO EXECUTE AN AGREEMENT BETWEEN CONSOLIDATED COKE, INC. AND THE CHATTANOOGA METROPOLITAN AIRPORT AUTHORITY WHEREIN THE CITY IS A GUARANTOR. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CHATTANOOGA, TENNESSEE, That the City of Chattanooga be and is hereby authorized to reimburse the Chattanooga Metropolitan Airport Authority (CMAA) for one-fourth (1/4) of the cost of environmental testing, which is estimated to be $3,375.00, with one-half (1/2) of the remainder being paid for by the Trustee in Bankruptcy of Metro Express, Inc. and one-fourth (1/4) being paid by the Chattanooga Metropolitan Airport Authority (CMAA), with the City's share of payment to be borrowed from the Contingency Fund. BE IT FURTHER RESOLVED, That the Mayor be and is hereby authorized to execute an Agreement between Consolidated Coke, Inc. and the Chattanooga Metropolitan Airport Authority wherein the City shall act as guarantor of the obligations of the CMAA and in particular with regard to holding harmless and indemnifying Consolidated Coke, Inc. with respect to possible environmental pollution at the site.
